Terms of Service

1. Acceptance of Terms

By accessing or using MTQ Now ("Service"), operated by L Emquitee LLC ("Company", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

MTQ Now is an AI-powered documentation tool that helps automotive professionals generate professional write-ups from rough notes, voice recordings, and scanned documents. The Service includes web-based tools, mobile capture features, and document generation capabilities.

3. User Accounts

Some features may require account creation. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must provide accurate information and keep it up to date.

4. Acceptable Use

You agree to use the Service only for lawful purposes related to professional documentation. You will not:

• Use the Service to generate fraudulent or misleading documentation
• Attempt to reverse-engineer, decompile, or hack the Service
• Use the Service to harass, abuse, or harm others
• Violate any applicable laws or regulations
• Exceed usage limits for your subscription tier

5. AI-Generated Content

The Service uses artificial intelligence to generate documentation. While we strive for accuracy, AI-generated content may contain errors. You are solely responsible for reviewing, editing, and verifying all output before use. The Company is not liable for any inaccuracies, omissions, or consequences arising from the use of AI-generated content.

6. Intellectual Property

Content you input (notes, voice recordings, scanned documents) remains your property. The formatted output generated by the Service is licensed to you for your commercial and personal use.

All intellectual property rights in the Service — including but not limited to software, source code, algorithms, AI models, AI prompt engineering, system prompts, document templates, training methodologies, user interface designs, trade-specific language processing methods, voice-to-document conversion systems, multi-input document generation processes, and all related documentation — are the exclusive property of L Emquitee LLC and are protected by U.S. copyright law, trade secret law, and applicable international intellectual property treaties.

The name "MTQ Now" and associated logos, taglines (including "Write it right. Every time."), and brand elements are trademarks of L Emquitee LLC. Unauthorized use of these marks is strictly prohibited.

You may not:

• Copy, reproduce, distribute, or create derivative works of the Service or any part thereof
• Reverse-engineer, decompile, disassemble, or attempt to derive the source code, algorithms, or AI prompts of the Service
• Use the Service to develop or train competing products or services
• Scrape, crawl, or extract data from the Service for the purpose of building a similar or competing product
• Remove, alter, or obscure any copyright, trademark, or other intellectual property notices
• Sublicense, resell, or redistribute the Service or its output in bulk for commercial purposes without written authorization

Any unauthorized use of the Service's intellectual property may result in immediate termination of your account and may subject you to civil and criminal liability.

7. Subscription and Billing

Paid subscriptions are billed monthly. You may cancel at any time; cancellation takes effect at the end of the current billing period. Refunds are provided at our discretion. Free tier users may be subject to usage limits.

8. Privacy & Data Handling

Your use of the Service is subject to our Privacy Policy and Security & Data Handling page. Key points:

• Raw input (notes, voice transcriptions) is processed and permanently deleted after write-up generation
• Generated write-ups are stored under anonymous IDs with no user-identifying information in the record
• AI processing uses zero-retention mode — the AI provider does not store or retain your data
• Write-up content cannot be traced to a specific user from the database records alone

9. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, L EMQUITEE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless L Emquitee LLC from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

11. Modifications

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance. We will notify registered users of material changes via email.

12. Termination

We may suspend or terminate your access to the Service at our discretion, with or without notice, for violation of these Terms or for any other reason.

13. Governing Law

These Terms are governed by the laws of the State of Wyoming. Any disputes shall be resolved in the courts of Wyoming.
